Statute of the promotional and advertising contest \u201cHYBAJ NA BAJK\u201d<\/h1>\n

The statute of the promotional and advertising contest \u201cHYBAJ NA BAJK\u201d (hereinafter referred to as the \u201cStatute\u201d) governs the conditions for participation in the advertising contest, the method and procedure for carrying out the activities necessary for its implementation, and defines details of the rights and obligations of the participants in the advertising contest.<\/p>\n

I. Organizer and operator of the contest<\/h2>\n
    \n
  1. The organizer and operator of the contest \u201cHYBAJ NA BAJK\u201d is the Regional Tourism Organization Banskobystrick\u00fd kraj Turizmus, N\u00e1mestie SNP 1, 974 01 Bansk\u00e1 Bystrica, registered in the Register of Tourism Organizations of the Ministry of Transport of the Slovak Republic under No. 1943\/2018\/SCR, Company ID: 52132072, Tax ID: 2120899022<\/li>\n<\/ol>\n

    hereinafter referred to as the \u201cOrganizer\u201d.<\/p>\n

      \n
    1. The Organizer announces a promotional and advertising contest entitled \u201cHYBAJ NA BAJK\u201d (hereinafter referred to as the \u201cContest\u201d) according to the rules set out in this Statute. The prizes are provided by the Organizer.<\/li>\n<\/ol>\n

      II. Subject, purpose and duration of the Contest<\/h2>\n
        \n
      1. The subject and purpose of the Contest is to promote cycling tourism, active leisure time, and discovering cycling routes and bike trips in the Bansk\u00e1 Bystrica Region.<\/li>\n
      2. The Contest takes place through comments under contest posts on the Facebook social network, on the zahoramizadolami.sk profile. The task of the contestant is to add a photo from their bike trip in the Bansk\u00e1 Bystrica Region in a comment under the relevant contest post.<\/li>\n
      3. Recommended bike trips and tips for cycling routes are listed on the website www.zahoramizadolami.sk<\/a> in the HYBAJ NA BAJK section.<\/li>\n
      4. The Contest will run from June 22, 2026 until the date stated in the last contest post on the Facebook social network.<\/li>\n
      5. During the Contest, 10 contest posts will be published. Each contest post will present a selected cycling location, cycling route, or tip for a bike trip in the Bansk\u00e1 Bystrica Region and will also invite the public to participate in the Contest.<\/li>\n
      6. Those contestants who post a photo from their bike trip in the Bansk\u00e1 Bystrica Region in the form of a comment under one of the 10 contest posts will be included in the Contest.<\/li>\n
      7. After the end of the Contest, the Organizer will draw one winner of the main prize from all validly participating contestants. and 5 winners of smaller prizes in the form of promotional items in the Za horami, za dolami design.<\/li>\n
      8. Within the meaning of Section 3(5) of Act No. 171\/2005 Coll. on gambling and on amendments to certain acts, the Contest is not considered gambling. Within the meaning of Section 845(1) of Act No. 40\/1964 Coll., the Civil Code, as amended, the Contest is considered a game organized by the Organizer under the conditions and according to the rules set out in this Statute.<\/li>\n<\/ol>\n

        III. Conditions of participation in the Contest \u2013 Contest participants<\/h2>\n
          \n
        1. Any user of the Facebook social network may participate in the Contest by posting a photo in the form of a comment under a contest post with the HYBAJ NA BAJK theme on the zahoramizadolami.sk profile.<\/li>\n
        2. The photo must relate to a bike trip, cycling route, or cycling experience within the territory of the Bansk\u00e1 Bystrica Region.<\/li>\n
        3. A contestant may participate in the Contest repeatedly by adding a photo under multiple contest posts. However, each contestant is entitled to only one prize within the entire Contest.<\/li>\n
        4. The following person may not participate in the Contest:<\/li>\n<\/ol>\n

          a) a person who is in an employment relationship or a similar relationship with the Organizer, as well as persons close to such a person in accordance with the definition of this term pursuant to Section 116 of the Civil Code.<\/p>\n

          If it is proven that the winner of the Contest is one of the persons listed in letter a) of this paragraph, that person is not entitled to the prize, the prize will not be awarded to them, and the Organizer is entitled to draw an alternate winner.<\/p>\n

            \n
          1. A contestant who fraudulently interferes with the mechanism of the Contest for the purpose of obtaining a prize, which they otherwise would not have obtained or without which they would not have been able to participate in the Contest, is also excluded from the Contest.<\/li>\n
          2. Each contestant is entitled to withdraw from the Contest.<\/li>\n<\/ol>\n

            IV. Rights and obligations of contestants<\/h2>\n
              \n
            1. By participating in the Contest, the contestant confirms that they are the author of the photo or have the right to publish the photo.<\/li>\n
            2. The contestant is responsible for ensuring that by publishing the photo they do not infringe the rights of third parties, in particular copyright, personality rights, or the privacy rights of persons captured in the photo.<\/li>\n
            3. By participating in the Contest, the contestant grants the Organizer consent to use the published photo for the purposes of promoting the Contest, the HYBAJ NA BAJK campaign, and promoting the Bansk\u00e1 Bystrica Region as a tourist destination, in particular on social networks, the Organizer\u2019s website, and in the Organizer\u2019s other communication channels.<\/li>\n
            4. The Organizer reserves the right not to include in the Contest any photo that is contrary to good morals, legal regulations, the theme of the Contest, or the good name of the Organizer.<\/li>\n<\/ol>\n

              V. Prizes for winners<\/h2>\n
                \n
              1. The Organizer has dedicated a main prize worth up to \u20ac350 to the Contest.<\/li>\n
              2. The prize may, by agreement with the Organizer, be focused on cycling, hiking, or active leisure time.<\/li>\n
              3. The Organizer reserves the right to change the prize to one of similar quality and value.<\/li>\n
              4. The contestant is entitled to only one prize within the Contest.<\/li>\n<\/ol>\n

                VI. Awarding of the prize<\/h2>\n
                  \n
                1. For the purpose of awarding the prize, the winner of the Contest is obliged to provide the Organizer with the required cooperation.<\/li>\n
                2. The winner will be contacted via the Facebook social network.<\/li>\n
                3. For the purpose of awarding the prize, the Organizer is entitled to use the winner\u2019s personal data in accordance with Act No. 18\/2018 Coll. on the protection of personal data and to request from the winner of the Contest consent to the processing of their personal data to the extent of first name, surname, and the address to which the prize will be handed over or delivered to the winner.<\/li>\n
                4. The provision and confirmation of personal data is voluntary; however, failure to provide and confirm them is considered a failure to provide the cooperation from the winner necessary for handing over the prize, which results in the termination of the right to the prize. In such a case, the Organizer is entitled to draw an alternate winner.<\/li>\n
                5. Each winner has the right to refuse the prize.<\/li>\n<\/ol>\n

                  VII. Final provisions<\/h2>\n
                    \n
                  1. Prizes in the Contest are not enforceable through the courts. The prize cannot be exchanged for cash.<\/li>\n
                  2. In the event of any doubts regarding compliance with the rules of the Contest, the Organizer shall decide on the further procedure in accordance with this Statute and the generally binding legal regulations of the Slovak Republic.<\/li>\n
                  3. The Organizer reserves the right to amend this Statute and\/or the conditions of the Contest after its announcement. The Organizer reserves the right to shorten, interrupt, or cancel the Contest, including before the expiration of the Contest period. Any change to the Statute and\/or the conditions of the Contest or any shortening, interruption, or cancellation of the Contest will be announced by the Organizer on its website or on its communication channels.<\/li>\n
                  4. The Organizer reserves the right to assess the fulfillment of all Contest conditions by contestants and also the right to:<\/li>\n<\/ol>\n

                    a) exclude a contestant from the Contest for failure to meet any of the Contest conditions,<\/p>\n

                    b) not grant the right to the prize if the winner refuses to accept it or does not provide the necessary cooperation,<\/p>\n

                    c) hand over to the winner another prize of similar quality and value to the prize specified in Article V of this Statute.<\/p>\n

                      \n
                    1. The prize handed over to the winner represents a prize before taxation, and the Organizer bears no responsibility for any tax obligations arising from the winner\u2019s acceptance of the prize pursuant to Act No. 595\/2003 Coll. on income tax. Any other related obligations are binding on the winner.<\/li>\n
                    2. By participating in the Contest, the contestant agrees to the rules of the Contest and this Statute.<\/li>\n
                    3. By participating in the Contest, the contestant also acknowledges that the Facebook social network is not the organizer of the Contest, does not provide it, administer it, or is otherwise associated with it. The Contest is organized exclusively by the Organizer.<\/li>\n<\/ol>\n
